Show Notes: Nico Jacobellis ran a movie theatre in Cleveland Heights, Ohio. He was convicted of possessing and distributing obscenity after his theatre played Louis Malle’s award winning film The Lovers. The Supreme Court, in a 6-3 decision, reiterated that obscenity is not protected under the First Amendment, but reviewed the film like a censorship board and decided The Lovers was not obscene and therefore protected. Justice Hugo Black, in a concurrence, agreed that the film was not obscene, but argued that even if it were, it was protected by the First Amendment. Black was correct. Unfortunately, his opinion was not the main one.
