This week, the Supreme Court agreed to hear three cases in 2020 concerning the Civil Rights Act of 1964 and the prohibition against discrimination based on sex - and whether or not that includes discrimination based on LGBT status. The statute clearly applies to employment discrimination based on the sex of the employee - but does it also preclude discrimination based on LGBT status? Circuit Courts are split. The SCOTUS will address that split. They might even clarify it. We discuss the issues.
