Synopsis

In a rare occurrence, the Supreme Court justices wrote nine different opinions, five in favor of vacating the death penalty for Furman and four opposed. The majority found the application of the death penalty as applied to Furman to be inconsistent with the Eighth Amendment’s proscription of cruel and unusual punishment.
