The Law Ep 43 -- The FUCT trademark case - Iancu v Brunetti (2019)
25/07/2019 Duration: 26minShow Notes: The Lanham Act prohibited the federal registration of trademarks deemed “immoral” or “scandalous.” This provision kept Erik Brunetti from registering the name of his clothing line, FUCT. He argued that prohibiting trademark registration of his company name violated the First Amendment. The U.S. Supreme Court agreed with him and struck down that provision of the federal statute. He can now officially trademark FUCT. Links: The case itself: Iancu v. Brunetti The Incredibly Minimal yet Official FUCT website The Wikipedia page on FUCT ==== The Law with D.K. Bad Times at the El Royale - The Last Nighters - Episode 80
22/07/2019 Duration: 01h03minWe hit you with “Bad Times at the El Royale” starring Jeff Lebowski and an ensemble cast. Set in the late 60’s, several strangers who are each walking contradictions, meet by chance at Lake Tahoe's El Royale, a former hotspot hotel straddling the California/Nevada border. Morality becomes different depending on which side of the line you're on. This is a fun discussion on a Tarantino-esque film that folds over itself, but leaves rough edges so you can fill in some of the blanks in the story on your own - intentionally. We promise that the next episode will be our wrap-up on “Batman v Superman” and also a discussion on “Justice League” with a little “Man of Steel” spice added in for flavor with our Australian friend, Shaheen. The Law Ep 42 -- The citizenship question and the census -- Dept of Commerce v NY (2019)
18/07/2019 Duration: 28minShow Notes: In this 5-4 decision, the SCOTUS held last month that the Trump administration can not inquire about citizenship during the 2020 census. The court held that the administration offered only pretext and did not offer a genuine justification for reinserting the citizenship question, even though the question has been asked throughout most of the country’s history. The administration’s attempt did not violate any constitutional provisions but was a violation of the Administrative Procedure Act. Without the APA violation, there is nothing to prevent the citizenship question from being asked in the future. Links: The case itself: Department of Commerce v New York (2019) ==== The Law with D.K. Jaron Weidner On A Skateboard In Midair: Sounds Like Liberty: Episode 55
10/07/2019 Duration: 59minShow Notes: Before today’s interview we are going to jump back to one of my favorite Christian rock bands Reliant K with College Kids. Does it have anything worthwhile to say about the college experience? Where does it land on our scale from Dylan to July? Nicky’s pick is a noisy progressive record called The Fleeting Light of Impermanence by The Appleseed Cast out of Atlanta, Georgia. It’s ambient noise of the best kind with the vocals as another fantastic instrument. https://graveface.bandcamp.com/album/the-fleeting-light-of-impermanence I’ve got Sailing England by The Pounds. This is another folk album (big shock) with mouth harp and banjo to show that the Americana trend has most definitely crossed the pond. Each track has its own flavor. In some cases, it’s almost a gimmick; like Miss Me building layers of sound, or Walking Around with its ambient noise. Thankfully the solid production keeps it from getting too annoying. There is a continuum between charming and depressing I basically hang out ther
