    Show Notes:  The State of Alabama had a state legislature based in part on geographic districts (like counties) and not population. Plaintiff Sims lived in a very populous district with the same representation as those living in much less populated areas. Sims alleged his rights to Equal Protection pursuant to the 14th Amendment were violated by this system. The U.S. Supreme Court agreed and declared all state legislative districts had to be based on proportional representation and not geography.     Show Notes: Nico Jacobellis ran a movie theatre in Cleveland Heights, Ohio. He was convicted of possessing and distributing obscenity after his theatre played Louis Malle’s award winning film The Lovers. The Supreme Court, in a 6-3 decision, reiterated that obscenity is not protected under the First Amendment, but reviewed the film like a censorship board and decided The Lovers was not obscene and therefore protected. Justice Hugo Black, in a concurrence, agreed that the film was not obscene, but argued that even if it were, it was protected by the First Amendment. Black was correct. Unfortunately, his opinion was not the main one.   • The Law Ep 32-- Taylor v City of Saginaw (2019 6th Cir.): The Tire Chalking Case.

    A week ago, the 6th Circuit held that the government can not put chalk marks on tires of cars in an effort to catch those overstaying the government approved and allotted allowable time to park. The court held that such marking is a trespass on private property and an unreasonable search in violation of the 4th Amendment. While government chalk marks are among the least of the government’s constitutional violations, this case discusses the relevant analysis of unreasonable search cases. Its timely and unusual.     This week, the Supreme Court agreed to hear three cases in 2020 concerning the Civil Rights Act of 1964 and the prohibition against discrimination based on sex - and whether or not that includes discrimination based on LGBT status. The statute clearly applies to employment discrimination based on the sex of the employee - but does it also preclude discrimination based on LGBT status? Circuit Courts are split. The SCOTUS will address that split. They might even clarify it. We discuss the issues.
